Scope of Agreement This Equipment Rental Agreement (“Agreement”) between MabyKay Media Limited (“Lessor”) and the individual or entity renting equipment (“Lessee”) governs all rental transactions and associated documentation. By completing the online registration form and clicking the electronic “I agree” checkbox, the Lessee agrees to be bound by all terms herein. 2. Mandatory Renter Information ID Upload: Lessee must upload a clear copy of a valid government‑issued ID (International Passport, National ID, Voter’s Card, or Driver’s License). Personal Details: Lessee must fully complete all form fields—including full name as it appears on the ID, contact information, and address. Guarantor: Lessee must supply a guarantor’s full name, relationship, phone number, and email. Verification of the guarantor’s credibility and formal agreement to guarantee the rental takes 24–48 hours; rental is approved only upon successful guarantor confirmation. 3. Equipment Rented The following equipment at this link is rented at daily rates (per item) as agreed at booking. Lessee acknowledges reviewing and accepting the condition of each item at pickup. 4. Rental Period Start Date: As specified on invoice confirmation. End Date: As specified on invoice confirmation. Extensions require written agreement (email or WhatsApp) by both parties prior to original end date. 5. Pickup & Return Pickup Location: Plot 577b, Omole Phase 2 GRA, Ikeja. Pickup Time: 7 AM on rental start date. Return Time: 6 PM on rental end date. Grace Period: Lessee has until 7 AM the following day to return without penalty. 5.1 Return Inspection Procedure Lessee presents all rented items at the Lessor’s location by the agreed return time. Lessor inspects each item against the initial condition checklist. Any damage, missing accessories, or signs of abuse are documented on a Return Inspection Form, signed by both parties. If no issues are found, the form is marked “No Defects” and both parties sign to confirm. 6. Rental Fees & Payment Daily Rate: Charged per item per day as agreed at booking. Payment Method: Debit Card or Bank Transfer only. Payment Schedule: Full payment due upon booking and before pickup. Booking is confirmed only after payment. Cancellation: No cancellations or refunds after payment. 7. Additional Charges Late Return Charge (7 AM–9 AM): 5% of total daily rental cost. Extra‑Day Charge (after 9 AM): Full daily rate per item for each extra day or partial day. Damage/Loss: Lessee liable for repair or replacement costs (parts, labor). 8. Care & Use of Equipment Lessee agrees to: Operate equipment only in a proper, professional manner. Protect equipment from adverse weather, moisture, and extreme temperatures. Permit only qualified personnel to operate equipment. 9. Liability & Indemnification Lessee assumes full liability for equipment from pickup until return. Lessee shall indemnify and hold Lessor harmless from any claims, damages, losses, or expenses arising from Lessee’s use or possession of the equipment. 10. Damage, Loss, or Theft Lessee must notify Lessor immediately upon any damage, loss, or theft. Lessee is responsible for all repair or replacement costs. Lessor may inspect damaged equipment at its discretion. 11. Pre‑Rental Inspection Lessee is encouraged to inspect and acknowledge equipment condition prior to leaving the premises. Pre‑existing defects must be noted in writing. 12. Termination Lessor may terminate this Agreement and repossess equipment at any time if Lessee breaches any term or uses equipment improperly. 13. Guarantor Process – Upon submission of guarantor details, Lessor will contact the guarantor within 24 hours. – Guarantor must provide formal agreement (email or written) within 48 hours. – Rental approval is contingent on successful guarantor confirmation. 14. Force Majeure Neither party shall be liable for failure or delay caused by events beyond its reasonable control (e.g., acts of God, strikes, war, government action, pandemics). The affected party shall promptly notify the other, mitigate damages, and resume performance when possible. If the event lasts more than 30 days, either party may terminate without further liability (other than accrued charges). 15. Privacy & Data Protection Data we collect: Full name, contact details, postal address, uploaded government-issued ID images (passport, national ID, voter’s card, driver’s licence), guarantor details (name, relationship, phone, email), and a selfie where required for identity verification. Purpose & legal basis: We process your data to verify identity, perform and manage the rental contract (performance of a contract), to meet legal obligations (e.g., tax, fraud prevention), and — where applicable — on the basis of your explicit consent (see biometric processing below). Where we rely on consent, you may withdraw it (withdrawal will not affect lawfully completed processing). Biometric / Sensitive data: Images and facial templates used for identity matching may be considered biometric/sensitive personal data under the Nigeria Data Protection Act. You will be asked to give explicit consent (separate checkbox) before we collect or process selfies or use automated facial-matching technologies. If you do not consent, we may be unable to complete identity verification and your rental request may be declined. Processors & sharing: We may share personal data with third-party processors (identity-verification vendors, cloud hosts, payment processors, professional advisers). We will only engage processors under written Data Processing Agreements requiring appropriate technical and organisational safeguards. Storage & security: ID images and personal data are stored on encrypted servers (in transit and at rest). Access to personal data is restricted to authorised staff with role-based access controls, and administrative accounts are protected by multi-factor authentication. We maintain access logs and regularly review security controls. Retention & deletion: We retain Lessee and guarantor personal data for two (2) years after the rental ends for record-keeping and dispute/tax purposes, unless a different legal retention period applies. Where required by law, tax, litigation, or regulatory investigation, we may retain records longer; in such cases we will document the legal basis for extended retention. After the retention period ends we will securely delete or irreversibly anonymise personal data. Data subject rights & requests: You have the right to access, correct, delete (erasure), object to processing, restrict processing, withdraw consent, and request portability. To exercise any right, email privacy@mabykaymedia.com. We will acknowledge requests on receipt and respond without undue delay and in any event within 30 days (we may request reasonable identity information to verify the requester). If you remain dissatisfied you may complain to the Nigeria Data Protection Commission (NDPC). Breach notification: If we become aware of a personal data breach that is likely to adversely affect the rights and freedoms of data subjects, we will notify the Nigeria Data Protection Commission (NDPC) as soon as possible and, where feasible, no later than 72 hours after becoming aware of the breach; we will also notify affected data subjects when required by law. Registration & assessments: Where Mabykay Media becomes a “Data Controller/Processor of Major Importance” as defined by NDPC (for example, processing personal data of more than 200 data subjects in a rolling six-month period or as otherwise designated by NDPC), we will register with NDPC as required and comply with any registration obligations, fees and reporting. For any high-risk processing (including systematic biometric processing) we will carry out a Data Protection Impact Assessment (DPIA) and implement required safeguards. International transfers: If data is transferred outside Nigeria we will ensure it is protected by appropriate safeguards (contractual, onshore hosting, or other NDPC-approved mechanisms). By uploading an ID or selfie you confirm that you have read this Privacy & Data Protection clause and that you explicitly consent to the collection and processing of the personal data described above for the stated purposes (where consent is the lawful basis). 16. Governing Law & Dispute Resolution This Agreement is governed by the laws of Nigeria. Any dispute shall be resolved by arbitration in Lagos, Nigeria, under the Arbitration and Conciliation Act. 17. Entire Agreement This document constitutes the entire agreement and supersedes all prior oral or written agreements. 18. Electronic Signature By ticking the “I agree to the Terms & Conditions” checkbox, Lessee and Guarantor each consent to electronic execution of this Agreement, which shall have the same force as a handwritten signature.
